Prize Draw Rules
TRAGUS GROUP LIMITED ('TRAGUS'/THE
'PROMOTER') CUSTOMER SATISFACTION SURVEY PRIZE DRAW (THE 'PRIZE DRAW').
NO PURCHASE NECESSARY; A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
Open to all adults resident in the United Kingdom, over the age of 18 years, excluding employees of, and other persons connected with, the Promoter and Market Force Information (Europe) Limited (see below under 'Eligibility').
By entering, entrants agree that the Promoter and Administrator (as defined below) shall not, subject to the provisions of this paragraph, bear any liability for, and entrants agree to release, indemnify and hold the Promoter harmless from, any losses, damages, claims, actions and any liability of any kind resulting from participation. Nothing in these Prize Draw Rules shall exclude or limit the liability of the Promoter or Administrator for death or personal injury caused by the negligence of the Promoter or Administrator (as the case may be) or for fraud or for any other liability which cannot be excluded or limited under applicable law.

THE PROMOTER
The Prize Draw's Promoter (referred to as the 'Promoter') is:

THE PRIZE
One prize of a Tragus voucher (or vouchers in denominations determined by the Promoter) to the total value of £250 ("the Voucher") will be awarded for each Prize Draw. There is no cash alternative and no replacements will be provided in the case of lost or stolen Vouchers.
The Voucher may be used towards purchase of food and/or drink at any of the Tragus restaurants listed on the Voucher. Participating restaurants will honour the Voucher in lieu of cash but change cannot be given for any purchase(s) made for less than the full value of the Voucher tendered as payment.
The Promoter reserves the right at its sole discretion to substitute any prize at any time for any reason with products, goods, services, vouchers and/or cash which it decides is appropriate in the circumstances.
PRIZE DRAW RULES AND
HOW TO ENTER
There will be a series of distinct and separate Prize Draws, each lasting one (1) week. The initial Prize Draw period starts on 09/1/12 at 00:00am on the www.oriel-feedback.com website and such other websites as may be determined by the Promoter, from time to time, at the Promoter's sole discretion (together the 'Websites') and ends on 15/1/12 at 11.59pm. Subsequent Prize Draw periods may follow each week, beginning on the Monday and ending one week later on the Sunday at midnight. Each subsequent Prize Draw will use the Websites. The Promoter, in its sole discretion, shall determine the number of Prize Draws to be held. The Administrator will post notice that the Prize Draws have ended on the Websites. Respondents will be included only in the relevant draw, only for the period during which their response was received.
To enter, you will be invited to complete a survey by a representative of the Promoter, by being given a survey invitation card at a participating location. You must complete the survey online on the relevant website in English. Each survey will be submitted to the draw for the Prize Draw period within which it was received.
The survey must be completed within the designated selection fields, marked on the online Prize Draw form. All areas marked with an asterisk ('*') must be filled out before submitting your form. Where areas marked * are not completed, the survey will not be entered into the Prize Draw. For each properly completed online survey, the entrant shall receive one (1) entry to the draw.
If you would like to enter the Prize Draw without having completed a survey, you may do so by sending to the Administrator by pre-paid post, a written request to be entered into the Prize Draw. Such requests must be in English, legible, and include your full name, contact telephone number and UK residential address.
All surveys, Prize Draw entries and information submitted within them shall be the property of the Promoter and will not be returned. In consideration of the opportunity to enter the Prize Draw, you assign and transfer to the Promoter any copyright you may own in your completed survey or Prize Draw entry.
You may enter as many Prize Draws as you like. Further, you may submit more than one entry for each individual Prize Draw. However, you may not submit more than 10 entries (by any means) for any one Prize Draw. If more than 10 entries are received from one person, household, group or organisation in a single week the Administrator reserves the right to exclude the excess entries or, in its sole discretion, exclude all entries from that person, household, group or organisation.
Each person, household, group or organisation is restricted to ten entries per Prize Draw (whether by way of a completed survey or a postal request to be entered into the Prize Draw). This means that, no matter how many surveys are completed or postal entries received, only a maximum of ten of the responses will be put forward for a draw in any one Prize Draw period. Respondents leaving a common address or telephone number will be considered, for purposes of the Prize Draw, to belong to the same household, group or organisation and therefore be subject to the above restriction.
All online surveys or postal entries must be received by the Administrator by the closing date of the current Prize Draw period in order to be eligible for that Prize Draw. Surveys or postal entries received after the closing date of the current Prize Draw shall be entered into the following Prize Draw, if any, subject to the limitations on the number of entries described above.
ELIGIBILITY
To be eligible, you must be resident in the United Kingdom and over the age of 18 years. You are not eligible if, during the Prize Draw period, you or a person you live with or any of your immediate family members (parent, child, sibling and spouse of any of the foregoing) is an employee, representative or agent of the Promoter or the Administrator or any of their subsidiaries, licensees or affiliates.
THE DRAWS
Every week, on the Monday following the Sunday of the previous week, the Administrator will hold a random draw for the Prize Draw which took place in the preceding week. A prize will be awarded to the randomly selected winner of the Prize Draw. The draw will be held at the office of the Administrator and will be conducted by the Administrator. If a selected entrant cannot be contacted, or has not supplied a UK postal address (and does not do so when requested), then the prize will be deemed to be forfeited and no substitution or other compensation will be awarded.
Further, if the selected entrant does not comply with these Prize Draw rules, that entrant will be disqualified and an alternative entrant will be randomly selected from the eligible entries received.
The Promoter will attempt to contact the selected entrant by telephone or email within 10 working days of the close of the Prize Draw. The selected entrant will be asked to provide a UK postal address for delivery of the prize or confirm the address submitted with the competition entry.
The prize will be sent to the postal address provided by the winner within five working days of the Promoter contacting the winner and receiving confirmation of the address as set out above. The prize will be sent by Royal Mail Recorded Delivery.
CHANCES OF WINNING
The chances of winning a prize depend on the number of eligible entries received and the number of the Promoter's outlets participating in the Prize Draw.
OTHER RULES
By entering, entrants agree to abide by these Prize Draw rules and all decisions of the Promoter will be final and binding on all entrants. This Prize Draw is subject to all applicable laws.
No correspondence will be entered into, except with the selected entrant who qualifies to win the prize. By entering, the winner grants the Promoter the right to use the winner's name, address, comments and/or likeness, without further compensation, in any advertising or publicity, except where prohibited by law. All entries become the property of the Promoter/Administrator.
The Promoters and Administrators reserve the right to cancel the operation of future Prize Draws at any time and in such event shall not be liable to any person for any reason who may have submitted a survey or request to be entered into a Prize Draw. The Promoter makes no representation as to how many Prize Draws will be held.
EVENTS BEYOND THE
CONTROL OF THE ADMINISTRATOR/PROMOTER
By entering, entrants agree that the Promoter shall not bear any liability for (a) entries which are lost, postage-due, stolen, illegible, incomplete (or otherwise improperly completed), delayed or destroyed (including, in the case of online entries, as a result of failure of the Websites or technical problems or traffic congestion on the Internet), (b) the loss, theft or misuse of the prize or (c) any property damage in any way attributable to this Prize Draw or the Prize (including, in the case of online entries, damage to any telephone network or lines, online systems, servers, access providers, computer equipment or software) or resulting from downloading any material from the Prize Draw Websites.
Where for any reason beyond the reasonable control of the Promoter or Administrator (including without limitation by reason of a virus, bug or other cause) a Prize Draw cannot be carried out or completed as advertised the Promoter reserves the right, in its sole discretion, to cancel, modify or suspend a Prize Draw. The Promoter and Administrator also reserve the right to cancel any affected Prize Draw entries if the security or proper administration of the Prize Draw or the validity of an affected Prize Draw entry is adversely affected. In the event of cancellation, termination or suspension, at its discretion, the Administrator shall select a winner from eligible, non-suspect or unaffected entries, received prior to the event requiring such cancellation, termination or suspension.
ABUSE
Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws and, should such an attempt be made, the Promoter and Administrator reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
Surveys obtained through fraudulent means or through an abuse of the Prize Draw or Surveys or Prize Draw entries which are in any way tampered with, forged, mutilated, illegible, incomplete or mechanically reproduced may, at the sole discretion of the Promoter and/or Administrator, be disqualified.
PERSONAL DATA
Except as set out in these Rules, the personal information which entrants provide to enter this Prize Draw will only be used by the Administrator to administer this Prize Draw unless any entrant indicates that he/she would be willing to participate in future surveys, in which case the entrant may be invited to do so on behalf of the Promoter by the Administrator, the Promoter or a third party appointed by the Promoter.
By entering a Prize Draw, participants consent to the disclosure in the event of a win of their name and county to persons enquiring (see "Winners Details" below).
The Promoter may additionally use the personal data provided by entrants in order to monitor and improve their customer service (including by attempting to resolve any complaint). Further, the Promoter or its nominee may engage in direct marketing to any entrant who indicates on their survey or postal entry that he/she would like to or join a mailing list to hear all about news and offers from the Promoter. You may opt out of such direct marketing at any time by notice in writing to the Promoter at the above address.
Unless otherwise indicated on the survey or in these Rules, the responses to the survey questions which any entrant provides will be used by the Administrator in an aggregated manner only and will not be linked to any entrant's personal information. For more information about the Administrator's commitment to all entrants' privacy, please refer to the Administrator's privacy policy online at Privacy.
Postcodes may be used by the Promoter for customer-mapping purposes.
WINNERS DETAILS
For the name of the winner for a specific weekly Prize Draw, send a self-addressed envelope to Tragus Group Customer Satisfaction Survey, C/O Market Force Information (Europe) Limited, Mount Mill Farm, Wicken, Milton Keynes, MK19 6DG, within thirty (30) days following the last day on the month in which the Prize Draw closing date falls. You must specify the applicable period for which you are requesting a winner's name. The winner's list will be sent only after the prize has been awarded.
LAW
These Prize Draw Rules shall be subject to the laws of England and Wales.
